These Terms of Service (the “Terms”) are between you and Joseph Tyree, doing business as Karnytine Labs (“Karnytine Labs,” “we,” “us,” or “our”), and govern your download, installation, and use of the Karnymail desktop application, its updates, and related documentation and support (collectively, “Karnymail”).
By downloading, installing, or using Karnymail, you agree to these Terms. If you do not agree, do not install or use Karnymail.
1. What Karnymail is
Karnymail is software that runs on your own computer. It connects directly from your device to the email, calendar, contact, and task services you choose, such as Google (Gmail, Google Calendar, Google Contacts, and Google Tasks) and providers that support IMAP, SMTP, CalDAV, or CardDAV. It can also import settings, signatures, and mail from other email programs and Outlook data files (.pst) on your computer, and export mail to Outlook data files.
Karnytine Labs does not operate a server that stores, relays, or reads your email, calendar, contacts, or tasks. Your content moves between your device and your service providers. Copies that Karnymail keeps for offline use, search, and speed are stored on your device.
2. Your accounts and responsibilities
You may connect only accounts that you own or are authorized to access. You are responsible for:
- keeping your device, Windows account, passwords, app passwords, and sign-in methods secure;
- complying with the terms, sending limits, and acceptable-use rules of each email, calendar, and contact provider you connect;
- the messages you send, the actions you take on your mail (including moving, deleting, archiving, and applying rules), and the data you import or export; and
- keeping backups of content that matters to you. Deleting, moving, or emptying folders in Karnymail generally makes the same change with your provider.
3. Google account access
When you connect a Google account, you sign in through Google in your web browser and choose whether to grant Karnymail access. Depending on the permissions you approve, Karnymail uses Google APIs to read, send, organize, and delete your Gmail messages; to view and manage your Google Calendar events; to view and manage your Google Contacts; and to view and manage your Google Tasks.
Karnymail's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. In particular:
- Google user data is used only to provide and improve the user-facing features of Karnymail that you use, and is processed on your device;
- Google user data is not transferred to Karnytine Labs or to others, except as necessary to provide those features, to comply with applicable law, or as part of a merger, acquisition, or sale of assets with notice to you;
- Google user data is not used or transferred for advertising, including personalized, retargeted, or interest-based advertising, and is not sold; and
- no person at Karnytine Labs reads your Google user data unless you give affirmative agreement for specific messages (for example, when you choose to send them to us for support), it is necessary for security purposes such as investigating abuse, or it is required to comply with applicable law.
You can disconnect a Google account at any time by removing it in Karnymail's settings and by revoking Karnymail's access at myaccount.google.com/permissions.
4. Information stored on your device
Karnymail stores account settings, downloaded messages and attachments, a search index, calendar events, contacts, tasks, signatures, and rules in its application data folder on your computer. Passwords and sign-in tokens are encrypted with Windows data protection tied to your Windows user account. When you import from another program, Karnymail reads that program's settings and saved credentials locally and stores what you choose to import in the same protected way.
Anyone with access to your Windows user account may be able to access this information. Removing an account from Karnymail deletes its locally stored data; uninstalling Karnymail may leave the application data folder in place until you delete it.
5. License
Karnymail is licensed, not sold. Subject to these Terms, Karnytine Labs grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use Karnymail on computers that you own or control, for your personal or internal business use.
Karnytine Labs and its licensors retain all rights, title, and interest in Karnymail, including its software, design, artwork, and branding. Open-source components included in Karnymail are licensed under their own terms, which control for those components.
6. Restrictions and acceptable use
Except where applicable law expressly permits otherwise, you may not:
- copy, redistribute, sell, rent, lease, sublicense, or commercially exploit Karnymail, except as allowed by an included open-source license;
- reverse engineer, decompile, or disassemble Karnymail, or bypass its security or licensing controls;
- use Karnymail to send spam or unsolicited bulk messages, phishing, malware, or unlawful, harassing, or infringing content;
- use Karnymail to access accounts, mailboxes, or data you are not authorized to access; or
- use Karnymail in a way that violates applicable law, your providers' terms, or another person's rights.
7. Third-party services
Karnymail works with services operated by others, including Google, Microsoft, and your email, calendar, and contact providers. Those services are governed by their own terms and privacy policies, and their availability, limits, and behavior are outside our control. Karnytine Labs is not responsible for third-party services, and they are not parties to these Terms.
8. Privacy
How Karnytine Labs handles information is described in the Karnytine Labs Privacy Policy. If you contact support@karnytine.com, the information you choose to send is used to respond to you and is not sold or used for advertising. Please do not send passwords or sign-in codes in a support request.
9. Updates and availability
We may provide updates, fixes, compatibility changes, and new or changed features. We are not obligated to provide any particular update or to support every version of Windows or every provider. Karnymail may stop working with a provider because of changes the provider makes, and we may discontinue Karnymail or its distribution.
10. Feedback
If you voluntarily provide suggestions or feedback, you grant Karnytine Labs a perpetual, worldwide, non-exclusive, royalty-free right to use it to improve, develop, and support our products. This does not transfer ownership of your own content to us.
11. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KARNYMAIL IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS. KARNYTINE LABS DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY.
WE DO NOT WARRANT THAT KARNYMAIL WILL BE UNINTERRUPTED OR ERROR-FREE, THAT MESSAGES WILL BE DELIVERED, SYNCHRONIZED, IMPORTED, OR EXPORTED WITHOUT LOSS, OR THAT IT WILL WORK WITH EVERY PROVIDER, DEVICE, OR FILE.
Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you. Mandatory consumer protections remain in effect.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KARNYTINE LABS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, MESSAGES, PROFITS, REVENUE, BUSINESS, OR GOODWILL, INCLUDING DAMAGES ARISING FROM THIRD-PARTY SERVICES OR FROM MESSAGES SENT, DELETED, OR MOVED THROUGH KARNYMAIL.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KARNYTINE LABS’ TOTAL LIABILITY ARISING OUT OF OR RELATING TO KARNYMAIL OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR KARNYMAIL IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIVE U.S. DOLLARS (US $5.00).
These limitations apply regardless of the legal theory and even if a remedy fails of its essential purpose. They do not exclude liability that applicable law does not permit us to exclude or limit.
13. Termination
These Terms remain in effect until terminated. You may stop using Karnymail and uninstall it at any time. Your license ends automatically if you materially violate these Terms. When your license ends, you must stop using and uninstall Karnymail.
Sections concerning ownership, restrictions, feedback, disclaimers, liability, governing law, and general terms survive termination.
14. Governing law and disputes
These Terms are governed by the laws of the State of Ohio, United States, without regard to conflict-of-law principles. Subject to any mandatory consumer rights in your place of residence, the state and federal courts located in Ohio will have exclusive jurisdiction over disputes arising from these Terms, and you consent to their jurisdiction.
Before filing a claim, you and Karnytine Labs agree to make a reasonable, good-faith effort to resolve the dispute informally for at least 30 days after written notice. Either party may seek urgent injunctive relief when necessary to protect intellectual property, confidential information, or security.
15. Changes to these Terms
We may update these Terms. The revised Terms will be posted on this page with a new effective date. If legally required, we will provide notice or obtain your consent before materially revised Terms apply to your continued use.
16. General terms
If a provision is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. You may not assign or transfer these Terms without our written consent. We may assign them as part of a sale, transfer, or reorganization of the relevant product or business. These Terms, together with the Privacy Policy, are the complete agreement between you and Karnytine Labs concerning Karnymail. Headings are for convenience only.
